White House Nondisclosure Agreements

On October 20, 2020, the Clinic published a comprehensive report on the use of nondisclosure agreements by President Trump's White House. The report evaluates the history of nondisclosure agreements in the private sector and in government. It then applies First Amendment doctrine to the Trump White House NDAs and concludes that the NDAs are unconstitutional in the vast majority of applications. First Amendment Fellow Tyler Valeska and Clinic students Michael Mills, Melissa Muse and Anna Whistler authored the report.
