The Clinic represents New York City-based news outlet The City and senior reporter Yoav Gonen in an Article 78 suit filed in October 2023 against the New York City Police Department. The suit seeks access under the Freedom of Information Law to the NYPD’s internal investigative file concerning an incident involving the NYPD’s top uniformed officer, Chief Jeffrey Maddrey. Maddrey allegedly ordered that the arrest of a retired officer be voided shortly after three boys alleged that the retired officer had chased them with a gun. While the NYPD’s Internal Affairs Bureau found there was no wrongdoing by Maddrey, the Civilian Complaint Review Board determined in 2023 that Maddrey abused his authority.
