Genesee County Department of Social Services v. Niasia J.

The Clinic filed a motion to intervene and unseal a transcript of an attorney disqualification hearing in Genesee County Family Court in June 2020 on behalf of upstate New York news outlet The Batavian. After a family court judge denied the motion, Clinic students Timothy Birchfield, Christopher Johnson and Ashley Stamegna filed an appellate brief in the Fourth Department. The Batavian came to us for assistance after its publisher was shut out from attending the hearing in person in violation of his constitutional, common law, and statutory rights of access. Stamegna argued before the Fourth Department in December 2021.
