Hayes v. Rich Anti-SLAPP Appeal

The Clinic represents several musicians from Central New York who were sued for libel after they accused a fellow musician of sexual misconduct. Although a lower court dismissed the suit against our clients, the Clinic is helping them seek reimbursement for their attorneys’ fees through New York's recently-amended Anti-SLAPP Law.

In April 2024, Clinic student Cameron Misner ('24) argued our clients' appeal before a five-judge panel at the Appellate Division, Fourth Department. A recording of the oral argument is available at the video below.

The Appellate Division denied our clients' appeal without explanation, affirming the lower court's refusal to award attorneys' fees. In July 2024, the Clinic asked New York's highest court, the Court of Appeals, to hear the case.
